Windsor Man Files Habeas Corpus Application Alleging Void Extradition Warrant, Missed Court Deadline

Court documents allege expunged mugshot used on federal warrant, extradition signed by DOJ counsel rather than judge

WINDSOR, ONTARIO — A Windsor resident has filed a habeas corpus application alleging that his 2005 extradition to the United States was based on a warrant that was "void ab initio" — legally invalid from inception.

Court documents filed January 29, 2026, by Francesco Giovanni Longo, 50, allege that:

  • The federal warrant (Case 8:05-cr-263-T-17MSS) was dated June 21, 2005 — allegedly 69 days before the crime date of August 29, 2005
  • An expunged 2004 mugshot was allegedly used on the warrant
  • The extradition authorization was allegedly signed by Faiyaz Amir Alibhai, a Department of Justice counsel, rather than a judge as required by Canada's Extradition Act, Section 12

The application further alleges that the court deadline for response has passed without a ruling, which Longo characterizes as a violation of constitutional due process under the Canadian Charter of Rights and Freedoms.

Longo served 18 months in Canadian custody and 78 months (6.5 years) in U.S. federal prison. His application seeks $57 million in damages.

Court records show that Justice Maria V. Carroccia of the Ontario Superior Court issued an endorsement on January 28, 2026. The status of the application remains pending.

"The case was dismissed. Mischief over $5,000. The Crown stated in open court it was 'no longer worthy of pursuing.' Why was all evidence destroyed within 14 days? Why were 79 files added 8 days after dismissal?"
